Terms & Conditions

The terms governing use of the website and ByteSync services.

Effective date: October 22, 2026

These Terms & Conditions govern access to bytesynctechnologies.com and the marketing, consulting, creative, web, advertising, analytics and provider-referral services offered by ByteSync Technologies (“ByteSync,” “we,” “us,” or “our”). By using the website, submitting a form or engaging us, you agree to these terms.

1. Website use

You may use the website only for lawful purposes and in a way that does not interfere with its operation, security or availability. You may not introduce malicious code, attempt unauthorized access, scrape or copy protected material, impersonate another person, submit misleading information, or use the website to violate law or third-party rights.

2. Services and proposals

Website content is general information and does not create a service agreement. The scope, deliverables, timing, fees, approvals, dependencies and responsibilities for a project are governed by the applicable proposal, statement of work, order form or written agreement. If a signed agreement conflicts with these terms, the signed agreement controls for that project.

3. Audits, estimates and results

Audits, recommendations, forecasts, estimates, case examples and performance expectations are provided in good faith for planning. Marketing results depend on budget, market conditions, competition, customer behavior, platform rules, data quality, approvals and factors outside our control. We do not guarantee rankings, traffic, leads, calls, sales, revenue, platform approval or a particular return.

4. Provider and partner information

Provider names, logos, plans, speeds, prices, promotional offers and availability belong to their respective owners and may change. ByteSync may act as a marketing or referral partner and is not the internet provider unless an agreement expressly says otherwise. Provider enrollment, installation, billing, service quality, equipment, taxes and customer agreements are controlled by the provider. Confirm current terms directly before purchase.

5. Client responsibilities

You are responsible for timely approvals, accurate information, lawful content, access credentials, rights to supplied materials, compliance with advertising and privacy obligations, and payment of agreed fees. Delays, incomplete information or third-party platform restrictions may affect timelines and deliverables.

6. Content and intellectual property

ByteSync retains rights in its pre-existing tools, processes, templates, code, designs, know-how and materials. Subject to full payment and the applicable agreement, you receive the rights expressly granted for final client deliverables. You represent that materials you provide do not infringe third-party rights and authorize us to use them to perform the services.

7. Third-party platforms

Advertising networks, social platforms, hosting services, analytics tools, providers and other third parties have their own terms, policies, outages, review processes and limitations. We are not responsible for a third party’s decisions, changes, suspension, loss of data or service interruption.

8. Communications and forms

Submitting a form authorizes ByteSync to contact you about your request. Email forms on this static website may open the visitor’s configured email application. Do not submit passwords, payment-card numbers, government identifiers or other sensitive information through a form.

9. Fees, payment and cancellation

Fees, payment schedules, deposits, expenses, taxes, cancellation rights and refund terms are stated in the applicable proposal or agreement. Unless that document says otherwise, approved work, third-party costs and completed deliverables are non-refundable. Either party may end an ongoing engagement according to the written agreement. Amounts due for work performed or committed costs remain payable.

10. Confidentiality

Each party will use reasonable care to protect confidential information received from the other and use it only for the agreed purpose. Confidentiality does not apply to information that is public, independently developed, lawfully received from another source or required to be disclosed by law.

11. Disclaimers

The website and general information are provided on an “as available” basis. To the extent permitted by law, ByteSync disclaims implied warranties of merchantability, fitness for a particular purpose, title, non-infringement and uninterrupted or error-free operation. Nothing in these terms limits rights that cannot legally be limited.

12. Limitation of liability

To the extent permitted by law, ByteSync will not be liable for indirect, incidental, special, consequential, exemplary or punitive damages, lost profits, lost revenue, lost data, loss of goodwill or business interruption arising from the website or services. ByteSync’s aggregate liability for a claim relating to a service will not exceed the fees paid for that service during the three months before the event giving rise to the claim, except where a written agreement or law requires otherwise.

13. Indemnity

You agree to defend and indemnify ByteSync and its owners, employees, contractors and partners from claims, losses and expenses arising from your supplied materials, unlawful use, breach of these terms, violation of third-party rights or misuse of provider information.

14. Governing law and disputes

Unless a signed agreement states otherwise, these terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Disputes will be brought in the state or federal courts serving Sacramento County, California, and each party consents to that jurisdiction.

15. Changes

We may update these terms by posting a revised version with a new effective date. Continued use after the update means you accept the revised terms.
